Alina has more than 10 years of experience, specialising in commercial dispute resolution.

Alina has advised and acted in a wide range of matters involving cross-border joint venture disputes, government-related contracts, as well as claims involving unjust enrichment, derivative actions, breaches of fiduciary duties, employment and sale of goods.

Her work spans both litigation and arbitration proceedings, including arbitration-related litigation proceedings.

Alina was previously appointed as young amicus curiae under the Singapore Supreme Court’s Young Amicus Curiae Scheme.

EXPERIENCE

Litigation

  • Successfully defended a high net-worth individual against claims of dishonest assistance, knowing receipt, conspiracy to injure by unlawful means and unjust enrichment in proceedings before the Singapore International Commercial Court, and on appeal: Esben Finance Ltd and others v Wong Hou-Lianq Neil [2021] 3 SLR 82; [2020] SGHC(I) 25, upheld on appeal in Esben Finance Ltd and others v Wong Hou-Lianq Neil [2022] 1 SLR 136; [2022] SGCA(I) 1.
  • Successfully acted in proceedings before the Singapore High Court and the Singapore Court of Appeal for a shareholder who sought leave to commence a derivative action against the company’s directors: Ma Wai Fong Kathryn v Trillion Investment Pte Ltd and others [2020] 5 SLR 1374, which was upheld on appeal.
  • Successfully acted for a shareholder before the Singapore Court of Appeal in seeking the winding up of a company for loss of substratum: Ma Wai Fong Kathryn v Trillion Investment Pte Ltd and others and another appeal [2019] 1 SLR 1046.
  • Acted for Singapore and Australian subsidiaries of an Australian listed company against an Indonesian coal conglomerate in the first case before the Singapore International Commercial Court, including the following reported judgments:
    • BCBC Singapore Pte Ltd and another v PT Bayan Resources TBK and another [2017] 5 SLR 77; [2017] SGHC(I) 6 upheld on appeal in PT Bayan Resources TBK and another v BCBC Singapore Pte Ltd and another [2019] 1 SLR 30; [2018] SGCA(I) 6

    • BCBC Singapore Pte Ltd and another v PT Bayan Resources TBK and another [2022] SGHC(I) 17, which appeal was allowed in BCBC Singapore Pte Ltd and another v PT Bayan Resources TBK and another [2024] 1 SLR 1; [2023] SGCA(I) 8
  • Successfully acted for inter-dealer brokers in a claim brought against them for alleged breach of purported employment contracts: BGC Partners (Singapore) Ltd v Yap Yuk Hee and others [2021] SGHC 279, which was upheld on appeal.
  • Successfully acted for a coal trading company in Singapore in obtaining a Mareva injunction against former associates and employees in dispute involving misappropriation of company assets and breaches of directors’ duties.

  • Acting for a consortium against a government-linked entity in resisting an appeal to set aside an arbitral award.
  • Acting for a consortium against a government-linked entity in resisting an application to set aside an arbitral award.
  • Acted for an international engineering company against a government in an appeal before the Singapore Court of Appeal to set aside an arbitral award.
  • Acted for an Indian company and several individuals in an application to set aside an arbitral award before the Singapore International Commercial Court.
  • Acting for a government-linked entity in resisting a claim for alleged breaches of a concession agreement in SIAC arbitration proceedings.
  • Acted for a government in resisting a claim for alleged breaches of a concession agreement in SIAC arbitration proceedings.
  • Acting for a large Indian conglomerate in resisting a claim for breaches of non-disclosure agreements.
  • Acted for a gaming operator in resisting a claim for alleged breaches of agreements in ICC arbitration proceedings.
  • Acted for an Indian coal supplier against a leading global coal company for breaches of a coal sale and purchase agreement in ICC arbitration proceedings.
  • Acted for a Philippine LPG supplier in bringing a claim against a Singapore company for breaches of an LPG sale and purchase agreement in SIAC arbitration proceedings.
