Nicholas specialises in both contentious and non-contentious intellectual property and information technology matters. Over the years he has developed a practice that is at the cutting edge of what clients look for in today’s business. As part of this practice, he has advised on both traditional intellectual property, technology and media matters, together with up and coming areas including data protection, digital asset management, decentralised online marketplaces, online falsehoods and non-fungible tokens (NFTs).

He has been named as a key individual in the firm’s intellectual property practice in the 2022 edition of the Chambers & Partners rankings, and has been described in the 2022 edition of the Asia Pacific Legal 500 as “responsible and able to provide pragmatic and commercial advice” and “highly recommended…for patent litigation”. He was cited as one of Singapore’s 70 most influential lawyers aged 40 and under by the Singapore Business Review 2016.

Nicholas is an active member of the International Trade Mark Association and its subcommittees, is part of the executive committee of the Asean Law Association, and is a member of the Institute of Singapore Trade Mark Agents.

  • Acted for the Sunseap group of companies in patent infringement suits commenced by Sun Electric Pte Ltd relating to solar electricity generation.
  • Acted for the Sunseap Group in commencing patent revocation proceedings before IPOS against Sun Electric Pte Ltd.
  • Acted for a Japanese printing company in refuting allegations of breach of memorandum of understanding and intellectual property rights infringement by a former business partner in relation to the development of a medical testing device.
  • Defended a Chinese game developer against claims of copyright infringement (including an application for an interim injunction) by a competing Chinese game developer in relation to a mobile first-person shooter game.
  • Advised an Indian computer software company in relation to a failure to deliver a bus deployment software solution by a sub-contractor.
  • Advised and represented the Singapore Government in various information technology related disputes against a multi-national company relating to the implementation of a civil service-wide network of computer hardware and software.
  • Advised a leading vehicle paint protection film manufacturer against companies in Singapore selling counterfeits bearing falsely applied trade marks.
  • Acted for the Tokio Marine Insurance Group in obtaining orders under the Protection from Harassment Act and a subsequent order for commmittal against a customer who posted false statements about them on Facebook and Tik Tok.
  • Acted for a Chinese road paving machinery company in arbitration proceedings under the SIAC Rules commenced by a Canadian road recycling company in relation to a failed joint venture.
  • Advised an Asian OTT media company on possible applications for judicial site blocking against various sites streaming infringing copies of TV productions.
  • Acted for an international software company against a local distributor in arbitration proceedings under the SIAC Rules for breaches by the latter of software licensing agreements.
  • Acted for a Swiss-based core banking software vendor in an ICC Arbitration against a Malaysian bank in a dispute arising out of a failed software implementation.
  • Acted for a Japanese construction company against an international software publisher in relation to allegations of copyright infringement arising out of a software audit.
  • Acted for an well-established corporation specialising in dyes in relation to defamatory statements made by a competitor.
  • Acted for a local HR software solutions company in relation to a claim for copyright infringement and breach of confidential information against a competitor.
  • Acted for a Japanese LNG trading company in commencing UDRP proceedings against a cyber-squatter.

  • Acted for a Japanese LPG trading company in relation to advising them on software implementation agreements and statements of work for various software solutions.
  • Acted for various government authorities in drafting agreements for a nation-wide QR code-based payment scheme.
  • Acted for a local FX trading start-up in drafting a software as a service (SAAS) agreement template for use.
  • Acted for a local food delivery start-up in relation to an assignment of intellectual property rights to a buyer in Thailand.
  • Drafted an intellectual property assignment and licensing agreement in support of a debenture issued by a client.
  • Acted for an international insurance group in relation to drafting template service and software licensing templates for use during IT implementations.
  • Advised various LPG brokerages in the UK in relation to whether the use of a set of common industry terms for LPG trading infringes the copyright of a company purporting to own the rights in them.
  • Acted for a local plant-based meat start up in relation to drafting their OEM and semi-OEM manufacturing agreement templates.
  • Advised a German auto manufacturer on regulatory matters in setting up an e-money, e-wallet in the Asia Pacific region.
  • Advised a well known Chinese game developer in relation to the use of unauthorised game servers.
  • Prepared personal data protection policy for various clients and advised clients on the requirement of consent for the use of personal data.
  • Advised a German auto manufacturer on the drafting of data privacy terms, user terms and conditions and enterprise onboarding agreements for a decentralised data marketplace.
  • Advised and negotiated on behalf of a German auto manufacturer in relation to software licensing and implementation agreements with various software vendors and service providers.
  • Assisted various clients in trade mark and intellectual property protection strategies both in Singapore and internationally.
  • Drafted clauses in an employment agreement for a client to enable the transfer of employees to a potential new entity.
